BOOKING TERMS AND CONDITIONS OVERVIEW FOR TRIPS

By booking a trip with us you agree to the following terms and conditions, given at the time of booking. 

CANCELLATION FEES

We understand that things circumstances change and you may need to cancel: 

Due to limited availability, we ask that you only book if you are certain that you can attend your chosen date.

The cancellation will only be effective from the date that the cancellation is received in writing by email. Cancellation charges will be payable as follows:

  • A non-refundable deposit of 30% is charged on booking.

  • A cancellation fee of 100% is charged if cancelled 60 days or less before the trip

CANCELLATIONS DUE TO COVID

If you are unable to attend because you have tested positive, our normal cancellation policies apply as above. 

You are strongly advised to have the appropriate travel insurance at the time of booking.

Refunds are not available in all instances of cancellation due to injury or illness including Covid-19.

RESCHEDULING

We do not routinely offer rescheduling but if there is flexibility we may be able to facilitate a request if the course is rescheduled in the same season. However, if you are unable to attend the date you booked in the same season, you will need to cancel your booking. Cancellation will only be effective from the date that the cancellation is received in writing by email. Cancellation charges will be payable as follows:

  • A non-refundable deposit of 30% is charged on booking.

  • A cancellation fee of 100% is charged if cancelled 60 days or less before the trip

INSURANCE

We recommend all guests have appropriate travel insurance that covers the nature of the activity that is being undertaken on the course book and that protects them from cancellation.

CANCELLATIONS BY US

Minimum numbers

If we do not reach the minimum numbers required for each course we reserve the right to cancel your trip.

This decision will be made 14 days before the start day of the course. If the course is cancelled we will refund your booking. 

If we are required to cancel we will not be responsible for any costs incurred from travel arrangements, accommodation etc. We recommend that you book flexible travel options and have appropriate travel insurance. 

Adverse Weather

Due to the nature of the region that we operate in there may be requirements to adapt the course programme to suit the weather or surface conditions for safety.

We aim to adhere to our itineraries provided at the time of booking, however, we may be required to make changes to the itinerary to accommodate the weather conditions. No refunds or rescheduling will be offered for changes to the itinerary.

If we are required to cancel your trip due to adverse and unsafe weather conditions, we will reschedule your trip for a later date or convert your booking to credit, valid for 12 months from the originally booked course date. 

If we are required to cancel due to weather, we will not be responsible for any costs incurred from travel arrangements, other accommodation etc. We recommend that you book flexible travel options and have appropriate travel insurance. 

BOOKING TERMS AND CONDITIONS FOR COURSES AND TRAINING

DEFINITIONS

a) References within the Booking Conditions to “Travel Arrangements” are to the accommodation, transport, activities, excursions and other services we feature on our website.

b) The references to “You” and “Your” means the persons named in the booking (including any person or persons added or substituted subsequently).

c) References to “We” “Us” and “Our” means Jådåt Adventure.

d) References to “Trip” “Trips” mean the trips listed on our website.

1. YOUR BOOKING

1.1 When booking you agree to our Terms and Conditions.

1.2 When you make your booking you agree that you have authority to accept and do accept on behalf of the party named in your booking, the terms of our Terms and Conditions and the Booking Conditions.

1.3 The person making the booking must be at least 18 years of age and authorised to do so by all persons named in the booking.

1.4 You are responsible for making all payments due to us under your booking. All party members named within the booking are jointly and severally liable for all payments due under the booking.

1.5 A booking contract will exist as soon as we issue you a Booking Invoice.

1.6 We do not accept any liability if we are not notified of any inaccuracies within 7 days of the issue of the Booking Confirmation Invoice to you. Once you have received your Booking Invoice please check this carefully. If any of the information contained within the Booking Invoice is incorrect or incomplete, please notify us immediately in writing as it may not be possible to make later changes to it.

1.7 We reserve the right to refuse to accept bookings at our absolute discretion without stating the reason for doing so.

1.8 You agree not to hold Jådåt Adventure responsible for any inconveniences, financial losses, or injury from your booking. We strongly recommend you take out comprehensive travel insurance at the time of booking.

2. SPECIAL REQUESTS

2.1 Special requests must be made at the time of booking. We cannot guarantee that the request will be met and any failure to do so will not be a breach of contract on our part. Confirmation that a request has been made will be included on your Booking Invoice or upon the acknowledgement of booking. We are unable to accept bookings which are conditional upon a special request being met and these will be treated by us as a standard booking.

3. PAYMENTS

3.1 In order to book your chosen trip, you must pay the 30% non-refundable deposit at the time of booking. We will inform you of your payment terms at the time of booking.

3.2 Your booking is not confirmed until we receive payment of your deposit and you have received confirmation from us. Our trips have limited availability so early booking is advised to avoid disappointment. We advise you not to book any travel arrangements until your trip has been confirmed by us.

3.3 You must pay the full balance by the due date set at the time of booking. If full payment is not received by the balance due date, we may cancel your booking and charge the applicable cancellation fees.

4. TRIP PRICE

4.1 We reserve the right to alter the prices of any of the holidays shown on our website. You will be advised of the current price of the trip you wish to book before your contract is confirmed.

4.2 Prices are subject to currency conversion rates, the final balance payable will be based on the currency conversion rate at the time of your final payment.

5. TRIP CHANGES OR CANCELLATIONS BY YOU

5.1 If you need to cancel your trip, you must send us the details by email to contact@jadat.co.uk.

5.2 Changes and cancellations by you may be subject to cancellation/amendment fees and/or non-refundable deposits.

5.3 Jådåt Adventure will charge the cancellation fee of 100% of the trip cost if the client cancels 60 days or less before the trip start date. A cancellation fee of 30% of the non-refundable deposit is charged if the client cancels at any other point.

6. TRIP CANCELLATION BY JÅDÅT ADVENTURE

6.1 Some trips will be subject to a group size minimum to run, and therefore occasionally have to be cancelled if this is the case we will inform you at the time of booking.

6.2 You agree not to hold us responsible for any inconveniences or financial losses from any trip cancelled by Jådåt Adventure.

7. COMPLAINTS

7.1 If you have a problem with your trip whilst on the trip, this must be reported to the Jådåt Adventure team at the soonest opportunity. If you fail to follow this procedure there will be less opportunity for us to investigate and rectify your complaint.

7.2 If you wish to complain when you return home we request that you send them to contact@jadat.co.uk within 28 days of the end of the trip.

8. FORCE MAJEURE

8.1 Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “Force Majeure”.

8.2 Force Majeure means any event beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our control.

9. HEALTH REQUIREMENTS

9.1 You must provide us with full details of any existing medical condition or disability that may affect your trip (including, in particular, any accommodation requirements) at the time of your booking.

9.2 If in our reasonable opinion, your chosen trip arrangements are not suitable for your medical problem or disability or you are not travelling with someone who can provide all assistance you may reasonably require, we have the right to refuse to accept the booking.

9.3 If you do not give us full details of your medical problem or disability we can also cancel the booking when we find out full details if in our reasonable opinion, the trip arrangements are not suitable or you are not travelling with someone who can provide all assistance reasonably required.

10. INSURANCE

10.1 Taking part in adventure activities carries a risk of personal property damage, personal injury or death. We do not accept or assume any responsibility or liability for damage to personal property, accidents, injuries or even death that occurred while taking part in any trip.

10.2 You must take out suitable insurance for all your needs before you travel. We cannot be held responsible for any costs you may incur as a result of failing to do so.

10.3 If you take part in activities whilst on your trip that have been organised and arranged independently of us, participation is at your own risk and it is your responsibility to ensure that you have obtained the relevant insurance.

11. YOUR RESPONSIBILITIES AND BEHAVIOUR WHILST ON YOUR TRIP

11.1 As part of your booking with us, you are accepting liability for any loss or damage to clothing, equipment or infrastructure caused by you or any member of your party during your trip. Payment for any loss or damage must be made to us at the time that it occurs or as soon as is reasonably practicable thereafter.

11.2 If the cost of the loss or damage is not known at the time, we will reasonably estimate it and if this reasonable estimate exceeds the amount paid, you must pay the difference once known, and if it is less, the difference will be refunded to you. You will also be responsible for and agree to indemnify us, in respect of any claim subsequently made against us and all costs incurred by us (including our own and any other party’s full legal costs) arising from your actions.

11.3 You are also responsible for the behaviour of yourself and other members of your party. We can refuse to accept you as a customer or refuse to continue dealing with you and any other member of your party by terminating your trip if your or their behaviour is or is likely to be, in our reasonable opinion, disruptive, upsetting or dangerous to yourself or anyone else, or if you or any member of your party have caused or are likely to cause property damage. In these circumstances, we will not pay any refund, compensation or other sum whatsoever or any costs or expenses incurred by you if we have to terminate your travel arrangements due to such unacceptable behaviour. In this situation, we will have no further responsibility for you or any other member of your party (including any return travel arrangements).

11.4 We cannot be held responsible for the actions or behaviour of other guests on the trip.

12. OUR WEBSITE AND ADVERTISING

12.1 The information contained in our website and advertising material is our responsibility and to the best of our knowledge and belief, it is correct at the time of publication. Occasionally errors may occur and information may change and you must therefore check all the details of your travel arrangements at the time of booking.

13 TRAVELLING TO YOUR TRIP

13.1 We are not responsible for how you arrive at the stated pick-up location for your trip. We will provide information regarding how to get there. Ultimately, it is your responsibility to research and make your travel arrangements.

13.2 With your permission we will connect you with other guests joining your trip, to see if you can arrange your travel together. You take full responsibility for your travel plans.

13.3 If you choose to share cars with other guests whilst on a trip, Jådåt Adventure is in no way responsible for any risk, injury or death that occurs through car sharing.

14. DATA PROTECTION

14.1 Information about you or members of your party, including your names, contact and details and any special needs, disabilities, and dietary requirements collected by us when you request information or make a booking with us.

14.2 We may disclose this information internally to provide you with your trip arrangements. Only information necessary for this purpose will be disclosed. On occasions, it may be mandatory for us to disclose information for security and terrorism purposes and any other purpose imposed upon us by governments or other regulatory authorities. We may use your information for the purposes set out in our Data Protection Registration with the Office of the Information Commissioner. We may disclose this information to companies which act as data processors on our behalf. Some information, for example relating to your religion or health, may be “sensitive personal data” within the meaning of the Data Protection Act 1998. We need this information to cater for your needs, but it is collected on condition that we have your positive consent. If you do not agree with our use of your information, we cannot accept your booking. By making a booking with us, you agree to allow your insurers, their agents and medical staff to disclose relevant information to us in circumstances where we may need to act in the interests of everyone in the group with whom you are travelling.

14.3 By participating in our courses and adventures, you acknowledge and agree that Jådåt Adventure may capture and use photographs and video, including images of individuals, for promotional and marketing purposes. However, we respect your privacy and offer the option for you to opt out. If you prefer not to have images of yourself used by Jådåt Adventure, please contact us to request that your images be excluded from our promotional materials.

15. LAW AND JURISDICTION

15.1 These Booking Terms and Conditions are governed by English Law with any action arising out of it being subject to the exclusive jurisdiction of the courts of England and Wales.
